PROPERTY RENTAL TERMS AND CONDITIONS

Please read the following terms and conditions before proceeding to the booking form by confirming your acceptance at the bottom of the booking form.

These Terms & Conditions govern all bookings through the owners, Ken & Margaret Rock. Any booking made or order placed by you, whether through our properties website or otherwise, shall be deemed an offer by you to rent the relevant accommodation subject to these terms & conditions.

All bookings through us and all matters arising from them are subject to English law and to the exclusive jurisdiction of the courts of England and Wales. The person who makes the booking accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party. Booking services with the owners are currently only available to persons who are at least 18 years old. By submitting a booking you warrant and confirm to us that you have read these Terms & Conditions and agree to comply with them.

LIABILITY
In consideration of the fact that the Owners acts only as a booking agent, the Owners accepts no liability whatsoever for any aspect of the arrangements and, in particular, accepts no liability for any loss, personal injury/illness or death however incurred. Although the Owners uses all reasonable endeavours to ensure the accuracy of all information provided and the quality and facilities of the apartments, we cannot accept any liability whatsoever for any problems that occur while guests occupy the rented property. All information has been provided in good faith and no liability is accepted whatsoever by the Owners for any misrepresentation of property material or accommodation.

DEPOSITS
A £150 refundable security deposit payment is required at the time of booking.

If the booking is made within two calendar months of the date of arrival then full payment of the booking fee and the deposit is required immediately. In the event that the property owner is unable to confirm availability of the property the owners will endeavour to offer a suitable alternative or a full refund of the amount paid will be offered. The owners will not accept responsibility for cash sent through the post. Payment can be made by cheque or a bank transfer to our bank account.

RENTAL PAYMENT
For bookings made more than eight weeks prior to departure the balance of payment is required no later than six weeks prior to the date of departure. If the final payment is not received within this period the owners reserve the right the cancel the booking and retain the initial deposit.

For bookings made within two months of the date of departure, full payment will be required at the time of booking.

BOOKING CONFIRMATION
Upon receipt of your initial booking and deposit the owners will send a booking confirmation to the party leader. Upon receipt of the final payment balance the owners will send an arrival guest information pack which includes with location map and directions to the property.

CANCELLATION BY YOU
The lead member of your party who has signed the booking terms must cancel the booking in writing and send it to the owners by recorded delivery. In this event we will apply the following refund calculations based on the entire booking value:

Cancellation more than 90 days before departure – Full refund less £25 administration costs.
Cancellation more than 42 days before departure – 50% of booking value plus deposit refunded
Cancellation 42 or less days before departure - Deposit only refunded

In certain cases any loss, if incurred involuntarily, may be covered by insurance that you may have taken out. We strongly recommend that all members of the party take out travel insurance.

CANCELLATION BY PROPERTY OWNERS
If deemed necessary, the owner reserves the right to withdraw or cancel the property booking. In this unlikely event, we will endeavour to offer an alternative property (subject to availability) with the price difference payable/refundable as appropriate, or of receiving a full refund of all monies paid to the property owner. No compensation is payable by the owner.

TRAVEL INSURANCE
All guests are responsible for ensuring that they have private travel and medical insurance appropriate for the country to which they are travelling. The properties rented are offered on the understanding that the occupants stay in the property at their own risk and the owners cannot be held responsible for accidents, injuries, illness, death or personal loss to occupant’s property.

SECURITY
Guests are responsible for the safe keeping of personal belongings during their stay. Guests should check that their travel insurance covers loss or damage to personal affects.

A safe is included in the apartment for your use. Please leave it open when you depart so that the next guest can set their own security code (the local agent has a key but may charge if they need to visit to reset the safe).

BEHAVIOUR
It is your responsibility to ensure that you and the members of your party do not behave in a way which causes offence or danger to others or which risks damage to property belonging to others. In such circumstances the property owners have the right to terminate arrangements made on your behalf, in which case the owners responsibility to you ceases immediately and there can be no refunds, no payment of compensation and no reimbursement of any cost or expenses you may incur as a result. Further, you will be liable to reimburse the owners for any expenses whatsoever that they incur as a result of your behaviour.

DAMAGE
The owners collects a refundable security deposit of £150 for an apartment in advance of the visit.

Guests will be held responsible and charged for the repair or replacement of any damage or breakages to the property or contents, caused during the occupation period. Should any damage occur the incident must be reported to the owners local property representative immediately and appropriate compensation and replacement can be arranged to avoid disruption to subsequent guests.

Guests are expected to take reasonable care for the property and its contents during their stay. All equipment, utensils and furniture must be left clean and tidy on departure from the property.

Sun loungers may be moved to the pool area for the use of your party. It is your responsibility to return the same to the apartment when you are not using them at poolside. Under no circumstances must any property for use inside the property, be moved outside.

The security deposit will be refunded, less any costs, once the local property agent has completed a full inventory check; this is normally within two weeks of your departure from the property. Costs may include repairs or replacement due to damage or loss, excess cleaning to the property, local agent call out charges etc.

CLEANLINESS
The properties that we offer are rented on the understanding that the property will be left clean and tidy at the time of checkout and all personal waste must be removed from the property.


SMOKING
For insurance reasons guests are not allowed to smoke within our properties.

AIR CONDITIONING
The cost for air-conditioning is included in the rental price. The air conditioning units must only be used while you are in the property, with all windows and doors kept closed. Under no circumstances must the units be left on while the property is unoccupied.

SWIMMING POOL
Guests use the communal swimming pool at their own risk. Guests are strongly advised not to let children use the swimming pool without parental supervision. The owners cannot be held responsible for any injury resulting from a guest using the swimming pool.

DISRUPTION
We regret that we cannot be held responsible for:
1. Any local disruption, delay or cancellation of your booking caused by local hostilities, riots, acts of terrorism, or political unrest.
2. Availability or disruption to supply of local utilities, water, electricity, gas
3. Availability of communal pools should they be taken out of use for health or safety or maintenance reasons
4. The working use of electrical items within the property such as TV, DVD, washing machine, microwaves etc.
5. Whilst we will endeavour to advise guests if we are advised or made aware of any major construction which is likely to cause noise pollution, we cannot control or influence when building work is undertaken.

CHECK IN / CHECK OUT TIMES
Access to Properties can be flexible if they are vacant. If there are guests leaving on the day of your arrival then to allow for cleaning, access to the apartment will be after midday on the day of your arrival and the property should be vacated by 11am on the day of your departure.

BABY COTS
The owners does not provide baby cots but we can assist with identifying local suppliers where you will be able to rent baby travel equipment pack with a travel style cot.

GUEST COMPLAINTS PROCEDURE
Whilst we hope that you will be very happy in your chosen accommodation and customer care is paramount to the service that we offer our guests, should you have a problem or a complaint please contact the local property agent in the first instance who will endeavour to resolve it. If you do not feel that your complaint has been adequately addressed please contact the UK office either by telephone during your stay or in writing within seven days of your return.
